Every state is different but I don't think the issue has to be linked to potential body injury/harm. Here's an excerpt from the California Lemon Law (notice that it's preceded by "either"):

either (1) The same problem results in a condition that is likely to cause death or serious bodily injury if the vehicle is driven and the problem has been subject to repair two or more times by the manufacturer or its agents, and the buyer or lessee has at least once directly notified the manufacturer of the need for the repair of the problem as provided in the warranty or owner's manual or (2) The same problem has been subject to repair four or more times by the manufacturer or its agents and the buyer has at least once directly notified the manufacturer of the need for the repair of the problem as provided in the warranty or owner's manual or (3) The vehicle is out of service because of the repair of any number of problems by the manufacturer or its agents for a cumulative total of more than 30 days since delivery of the vehicle.

In most States, the defect must materially affect the ability to use the vehicle, which, in many cases is a pretty high threshold.

I question if this is the best course of action. Spending $10K to exercise the Lemon Law, which will reimburse a depreciated value (miles driven before problem, and excluding any dealer add-ons). I'm basing this off California law so your YMMV. Wouldn't he be better off getting the Jeep repaired under warranty and then selling it?

I'm in a similar situation and I'm remotely considering going down the Lemon Law path. If I have to spend $10K, I'm better off eating the depreciation of my vehicle and selling it.

Woody,

If your list of issues is all you've had to deal with, consider yourself lucky. My list is twice as long and I've only half the miles. Anyway, I don't have advice to offer on the lemon law but I may be of help with one of your issues. Try hitting the unlock button first, then double tapping your hatch button. Mine works that way. I've read it's a safety feature to avoid kids playing with keys oppening the hatch. Best of luck to you.
