Your selling dealer was in Iowa so it is an Iowa contract and Iowa contract law would govern it. I am clueless about NC and FL Attorney General consumer protections about the transferability in this scenario. From all the talk it appears that if selling dealer was in NC/FL it would be transferable.

I no longer have my 2011 GC w/ the lifetime MaxCare but when I got it the option to transfer the warranty ONE TIME was there for a $50 fee. I'm in NC as well. My understanding is that it's only allowed in NC and FL due to state law..meaning..it doesn't matter if your contract says it or not if they don't allow you to do it that would violate state law. If the dealer that sold you the warranty won't back you then it might be worth having your attorney write a letter reminding everyone that NC law requires it. I don't know the GS (General Statute) for it...but an attorney should be able to find it easily.

This is a HUGE point that you need make very clear with the buyer and your attorney. The word WARRANTY should be stricken from the conversations. Your contract is an extended SERVICE CONTRACT, it is NOT an extended WARRANTY CONTRACT. That can make all the difference in the world. The two terms are not interchangeable when dealing with consumer contract law, regardless of state.

I didn't. I traded it in on the new '14 Summit Diesel. Mentioned that I had it and could transfer it but the dealer didn't care since they were just going to flip it and didn't need to fix anything.

and here is the applicable General Statue, I think. It says it has to be transferrable but it also says it doesn't apply to distributors selling them which I think the dealer is....confusing chit!

I was thinking too, the policy was purchased outside of NC but my address (associated with the policy) is in NC. Wonder if that matters.

Its an Iowa contract so their law rules unless its one of those state "mine is bigger than yours" contests like CA pulls all the time. Only a NC Atty can guide u accurately. A recent example, albeit not srvc agreemnt, was the 24 mo expire for gift cards then monthly fees that all national issuers had. Ohio was one of a hand full of states that said "That's a nice thought, but they never expire in Ohio and no fees ever."

I think your issue will b that law may b on your side (Iowa seller knowingly sold to NC resident so must follow NC srvc agree law) BUT how do you get from that high ground to the trenches where u r trying to transact with a local buyer and given them ironclad transfer paperwork. U gotta make sure this sale doesn't come back and bite u.

I think I read about this happening to another member on forum, but I think that one was in FL. I think if I remember correctly when you buy the contract the selling dealer needs to set it up as a contract for that state. I could be wrong but I think its something that needs to be done when you buy it. Maybe the person that had that happen could post something and explain it better?

BINGO --- I think you are referring to me.

YES, it is VERY helpful if the selling dealership sets it up correctly for FL and NC residents BEFORE it is issued. Can it be done after the fact? Yes, but a huge huge huge hassle - the consumer protection laws of your state of residence apply here, NOT the laws of the selling dealership's state. Basically, you need to call the Iowa dealership and explain that they sold the contract to a NC resident and THEY need to correct the matter. The good folks in Iowa should step up to the plate and resolve it for you...(unlike the folks in Michigan...gotta get that dig in ONE MORE TIME!). NC state laws apply here as YOU are the consumer...NOT the laws of Iowa...trust me on this one. The Iowa dealership should deal with Chrysler directly to fix for you...my contacts with Chrysler directly were very frustrating as no one knew anything at Chrysler!

Ultimately for me, since I was under 36 months, I cancelled and got a large chunk refunded and called it a day. Was I happy about it, no, but this was the quickest, easiest way to move on with the Michigan dealership's mistake. Could I have pressed the issue and made them correct it, yep, but wasn't worth a couple of hundred dollars to me.

Actually, NC laws apply since they were selling to a NC resident. But Chrysler issued the policy as if an Iowa resident (I am assuming from the discussion) which was a mistake...the dealership should have clarified it with Chrysler before it was issued. Once Chrysler issues it it is what it is until you go through the hassle to make Chrysler change it which they didn't have an easy contact to do it when I tried. Basically, the Michigan dealership could have cancelled mine and reissued it since I was under 36 months...they would have had to eat the difference. Ultimately I wanted out anyway as I figured a buyer wouldn't probably pay enough more to cover it's cost. I was out a few hundred dollars by canceling but PERHAPS would have been out the same or a bit more since a buyer might not have paid enough extra to cover it. A judgment call and I took the less hassle way out...
