Did the file not attach?

so i'm getting all kinds of different messages. The sale fell through due to this issue but i'm sure another one will come around.

i'm calling the dealer tomorrow who sold me the contract to see if there is anything the can do. i'm sure they can't but it's worth a call.

Attached is the provision plan my plan info on it.

i wish there was an attorney on this thread.

so i was just told that since i purchased the warranty from Iowa that it could not be transferred.
However, if i lived in another state (let's stay i lived in Iowa) i could buy the warranty from a NC dealership that it WOULD transfer to another buyer. it's all about where you buy the warranty, not where you actually live.
Still makes no sense to me and I don't like this answer. I'll need to sleep on my next move... the Iowa dealer mislead me.

Groundhog Day...

Actually, I think technically, it is WHERE YOU RESIDE that is the controlling law, not where you bought it. I am assuming that NC has a consumer protection law that covers its citizens and so would apply to you even though you bought it from an out of NC state dealership. For simplicity Chrysler probably goes by what state it was sold through...but that is most probably NOT correct. In the end, Chrysler is selling the service plan to a consumer...and this consumer lives in NC regardless of where the selling dealership is located. See Chrysler marketing brochures that make no requirement that the dealership be located in NC.

The good news is the Iowa dealership I am sure will try their best to make this right for you. Moreover, Iowa has a top notch Insurance division (headquarters of many insurance companies...surprising fact) so that could be a contact for you too...but your best insurance commission contact would be the NC commission as they are their to protect NC citizens and enforce NC laws when companies fail to abide by the letter of their laws for whatever reason.

i was pointed to the NC Attorney General's office. Some lady named Jessica who handles Auto. Of Course she's out of town until 12/29.

To help fast forward this (as i think now it's a legal issue) i'm going to fill out a complaint form here (unless someone states otherwise):

If the Iowa dealership can't resolve it for you, I would simply write a demand letter (certified, return receipt requested) to Chrysler explaining that you were at the time of purchase of their plan an NC resident and have remained so to this day and demand that the plan be made transferable per NC law (cite the NC statute if possible). Note at the bottom you are copying it to your attorney Name, Esq. and to NC insurance commissioner.

I would also work the phone to get a higher up on the line.

Unless the Iowa dealership will step up to the plate (that is IF they even can especially since beyond the 36 months) you're in for a hassle for sure as I went down the same road and just went the better route for me of canceling the contract and taking the relatively small hit...doubt my buyer would have paid me the full cost of the contract anyway so I was probably better off money wise doing what I did and saved a ton of frustration and hassle. But then again, I would have liked to have been able to market my 2011 as having a Lifetime service plan...who knows what buyers may have popped up!

Good advice.

So i'm currently filling out a complaint form on the NCDOJ to Chrysler with these specifics.

Could the DOJ point me to the actual statute? i would imagine they could.

At this point it's the principal vs. the money. it's only going to make a few thousand dollar difference in the sale if i can or can't include the warranty.

any info on the statute might help solidify my case...

The lady you mentioned that is out until the 29th or one of her co-workers is probably the easiest way to get the information. Will be interested to see how this gets resolved as it was sold to you, an NC resident.

I just submitted this complaint against Chrysler to NC Attorney General

I purchased a lifetime "Max Care" warranty from Wittrock Motor Compnay in Carroll Iowa. This contract was called the lifetime maxcare warranty from Chrysler. The warranty was suppose to be transferable 1 time from the original owner to 1 subsequent owner. Specifically stated, this was only applicable if the owner was in NC and FL. why that was defined i don't know. Upon sale of the vehicle I could make the transfer. however, when it was time to make the transfer, i was told by Chrysler that it could not be transferred. that being said, several representatives said it could transfer (i have this conversation recorded) but when they moved me up the line (to a higher rep) i was told since i purchased the warranty in Iowa it could not be transferred. However, it's my understanding that the warranty follows the registered owner of the vehicle (me, in NC) not the state from where it was purchased.
