I did but was under 36/36,000 so cashed mine in (canceled it) and took a small hit.

Have you transferred a lifetime in Florida yet?

Re: Lifetime Maxcare Warranty Transfer-Help

Meant Chrysler is saying my Lifetime service contract is not transferable because I bought it online. Think they are wrong (and they have said a number of things that just aren't so) but have no plans to sell.

However was wondering if other Floridian JG members have had the same thing happen. Am considering contacting the Florida Consumer Protection agency but just not ready to do that yet. At the same time I have assembed A Lot about relevant Florida laws and Florida license number 65505 (and its predecessors 60029 & 60130).

Yes, Chrysler told me my service contract (GC 2011) was NOT transferable. I was at the time and have continued to be a Florida resident. I bought my 2011 from a Florida dealership too but bought the service contract online from an out of state dealership (Michigan). Instead of fighting it I canceled my service contract and took the money less the fee and some proration. I am SURE glad I checked into it BEFORE listing it on autotrader.com as the buyer would have been VERY upset I am sure AND it would have been AFTER the 36/36,000 --- would have been a cluster mess up for sure.

The bottom line, if YOUR service contract does NOT say it is transferable then you are in a huge huge huge hassle to get it fixed!

Re: Lifetime Maxcare Warranty Transfer-Help

And it was my thought that other Floridians with Lifetime warrenties bought online might want to fight this once and get it corrected before it is a hassle.

BTW the sample plan I was sent before purchase and also required by Florida law clearly said it was transferrable once which is all I expect (see the earlier post). I did not see any mention that it was not until I looked online in December.

Did they send you a LIFETIME sample plan?

So what you are saying is that you have a non-transferable lifetime plan...that is, the plan you have in your hands says non-transferable?

Re: Lifetime Maxcare Warranty Transfer-Help

My plan that is on the Jeep website says it is non-transferrable. Pixels can say anything but I have lots of other documentation saying it is and the rationale given that Florida requires plans to be sold for MSRP is not true and has not been controlled at all since 2011 but is Chrysler's mantra.

Bottom line: Chrysler's Service plan is licensed to be sold in Florida (Fla License 65505) and must follow Florida rules when sold to someone in Florida (actually I suspect that if a car with such a service contract was sold in the state of Florida, it must comply but am not a lawyer and do not want to sell mine to find out).

I have tried to be nice and have lots of documentation but am getting tired of getting prevarications.

But the bottom line is that it appears the underwriter "CHRYSLER GROUP SERVICE CONTRACTS LLC" being licensed in Florida is bound by Florida laws

Among other things I asked that specifically of the online dealer before purchase and received an e-mail reply:

1) The MaxCare.pdf file shows the warrenty as being underwritten by "Chrysler Group LLC”, PO Box 2700, Troy, MI 48007-2700" is
this who underwrites the contract referenced by this quote ID ?. (Lifetime Added Care plus LWA100N) The same company
underwrites all our plans... Chrysler Group...
2) I understand this is tranferrable in Florida, is this correct ? Yes

(My initial questions in italics, their response in bold. I have the original e-mails)

Re: Lifetime Maxcare Warranty Transfer-Help

After sleeping on it a bit longer I have an opinion that is a bit different. Naturally my thoughts are Florida specific though may apply to North Carolina. I am not a lawyer (but deal with contracts.

That said I believe that the Chrysler employees I have dealt with so far are not those able to make decisions and are not responsible for following their instructions and the scripts they have been given. Any mythcnceptions are those of the CHRYSLER GROUP SERVICE CONTRACTS LLC and not the people I've spoken to.

OK then how I think all of this will play out:
1) Any vehicle whose title is transferred in Florida that has a service plan underwritten by an entity holding a Florida company license comes under the purview of Florida law.
2) Does not matter where the service plan/contract/agreement was originally purchased the key is that a valid service plan (as defined under 634) exists, the title is transfered in Florida, and the underwriter holds a Florida license (curently 65505)

Anything further is going to require a Florida Lawyer (and one thing Florida has is lawyers. Last time I looked there were more lawyers than doctors in the phone book and are even more in Tallahasee).

Will just observe that they way the plan is written if someone with a plan expires, when the title is updated, the widow/widower would have nothing.

It may wind up requiring a court's decision but I hope not.

ps strictly speaking my plan is "lifetime" in name only. It has both an expiration date and a mileage limit.

pps since I have no plans to sell mine, for the moment the question for me is moot (but interesting.)

Re: Lifetime Maxcare Warranty Transfer-Help

I'm still in the same boat. No info back from Chrysler since my claim.
Oddly my jeep isn't moving in eBay, autotrader, and cars.com. So the transfer of warranty might not be an issue if it doesn't sell.

Re: Lifetime Maxcare Warranty Transfer-Help

Looks like JM&A may really be Fidelity. If so I would check them out thoroughly.

Despite my ranting I still think the Chrysler service plan is the best one for my Jeep, just need to be certain that if I give it to someone in Florida they will receive the warrenty also.

Re: Lifetime Maxcare Warranty Transfer-Help

Update: My '12 Jeep is still under the 3/36 warrenty but was just told if I cancel the Chrysler plan it would cost me about $700.

I like the plan so will just keep and if/when it is decided to sell/give away, I'll let the legal eagles battle it out. By then maybe someone with deep pockets will have set a precedent.

Of course I could always donate to a Florida law school and get a tax deduction...
