Re: Lifetime Maxcare Warranty Transfer-Help

I think it's over. I received a letter from Chrysler from my inquiry to North Carolina dep of commerce (I think that's what it was). They attached a copy of my contract with a letter saying then I purchased the warranty in Iowa and therefore it was not valid in North Carolina for a transfer. Of course my wife threw away the letter. I meant to scan it and attach to this thread. I've given up and my jeep is still in the garage.

Re: Lifetime Maxcare Warranty Transfer-Help

Hmmmmmmm.......I guess they are taking that position even if probably erroneous if challenged in court. While I don't like litigation, seems like this would qualify for a class action lawsuit to settle it and pay for the attorney. They are totally wrong in my opinion as it doesn't matter where it was bought as long as they knew or should have known where you lived...such as your address on the contract. These things aren't fun...like banging your head against a wall. Watch "The Rainmaker" and "A Civil Action" movies for fun and motivation! But I suspect you'll just move on and forget about it...sorta like I did when I just canceled my contract and moved on (at least I got 80% or so of the money back). I wonder if you can lease it out forever and keep the lifetime warranty - stick it to the man... LOL

Re: Lifetime Maxcare Warranty Transfer-Help

I thought about that. Leasing it out for a while. Then I thought about what happens when the person doesn't pay then trying to track down the jeep blah blah. Then I thought about what my time is worth and its a heck of a lot more than tracking down some dude not paying his lease.
I really think they're in the wrong, and, if I had the energy or time to roll up a class action lawsuit (my dad is a criminal defense attorney so I'm familiar with the process) I would go after them. However, in the short term, my jeep isn't selling which is strange to me. It's about 1k under KBB as currently advertised.

Re: Lifetime Maxcare Warranty Transfer-Help

Yep - looked it up. You got a lot of miles on it which is perfect for lifetime. Keep it and run up the miles unless you're itching for a new one. Do you have a trusted relative etc. to "lease" to that drive a lot of miles? I'm just thinking at least get your money's worth out of the lifetime, you paid for it!

Yeah, Chrysler not honoring where you reside (like they said to me) does piss me off. They make the same about on the contract no matter where it sells so what do they care which dealership sells it and at what price?

Re: Lifetime Maxcare Warranty Transfer-Help

The "high up" guy at Chrysler said if I had purchased the warranty in NC it would have transferred. Since it was purchased out of state it wouldn't. Such BS. It's a manufactures warranty. Doesn't matter where the policy was written, at least it's my stance. I've tried to sell it to a friend/ relative but they say it's too nice or maybe too much money.
I've already bought a new Tahoe so the jeep is just sitting in the garage.
Curiously what type law do u practice?

Re: Lifetime Maxcare Warranty Transfer-Help

I'm sure you guys wouldn't find it worth the time, effort, or expense. But if you pressed Chrysler on this issue in a NC or Florida court you would probably win! (Apparently NC & FL are the only states that require by state law an extended service contract be transferable to a second buyer)

I don't see how Chrysler could argue that they do not have to follow the consumer protection laws of any state as they obviously do business in each and every state and of course must abide by the individual laws of each and every state as they relate to automobile sales and service in those states. Where you purchase a product or service shouldn't matter at all.

If you purchase a vehicle or service in one state (where you may have found the best price) but choose to register and title that vehicle in your home state, your home states laws as to any sales taxes owed or registration fees paid will always apply. As will any new car consumer protection laws applicable in that state also apply. A car registered, titled, and insured in NC or Florida must abide by the state laws applicable for those who live and register their vehicles in those states and any manufacturer who sells vehicles in those states must also abide by the same rules!

If one received their best price and purchased a vehicle in one state and registered that vehicle in their home state only to find out later it was a lemon......Does the lemon law of the state you bought the vehicle in apply, or the lemon law of your home state apply? I'm sure you'll find the lemon law for your home state where you registered the vehicle would dictate what you do next. Chrysler wouldn't get to choose what state consumer protection lemon laws should apply. Would they? No, if you live in NC or FL those states consumer protection laws would apply to any and all residents of those states and to any car manufacturer that does business with the residents of those states!

How could Chrysler argue in a state court that they don't have to honor the consumer protection laws of NC or FL as to the transferability of service contracts, regardless of where they may have been purchased. A licensed Chrysler dealer sold you an extended service contract and knew where you lived when they took your money for that service contract. They then entered your service contract into the Chrysler service contract database with your Name, Address, and VIN so you would be eligible to obtain service at any Chrysler dealer in the country. It would be very difficult for them to claim they didn't know you might be a resident of NC of FL and that they might have honor NC or FL consumer protection laws for that service contract. Wouldn't it?

Think about it..... with the internet one can purchase virtually anything from anywhere, as long as you have the ability to pay and abide by all federal, state, and local laws. These state or local laws apply to both the buyer (You) and the seller (Chrysler). (Reference CA for their emissions laws, or NY for their insurance and inspection laws) Especially for an industry that is as heavily regulated, monitored, and controlled as the automobile industry is in this country at both the State and Federal level.

Re: Lifetime Maxcare Warranty Transfer-Help

Raptor your points are valid and well stated. As to your first point- the time, effort, and expense wouldn't be worth the "one time warranty transfer" that I would get when selling the jeep.
If there was some form of lawsuit that could make me and/or an attorney some $ while devoting time to the project I would consider pushing forward.
I'm not happy about it at all as I think I'm getting screwed. Unless I can find some other loophole I'm putting this to bed. I learned a valuable lesson about doing business with Chrysler.
