(oh, and by the way, some tuners leave a signature that cannot be "reflashed" out, so the dealer you hate so much until you need his warranty will know you are lying).

So you are saying you would recommend someone fight a warranty claim for engine failure that is denied due to ECU modification in court with legal fees and everything?

I'd recommend they not do that because they'd lose, and lose a lot of extra money trying to win.

You can know your rights all you want. I've seen tons of cases where a manufacturer will refuse warranty service due to an aftermarket part that would have not caused the problem. The problem is, are you willing to lawyer up, spend tons of money, miss a lot of work and wait 6 months to get someone to enforce the law?

Also as integrated as today's vehicles are with the ECU, it would be very easy for them to claim almost any problem was caused by the unauthorized reflash of the ECU. I suspect they could argue anything from transmission failure to light bulbs burning out. Heck if you have quadra lift I old even see them blaming suspension issues on it.

I'd want to be 100% sure the dealer could not see that it was reflash ed. My Superchips for my JK saves off the stock programming so I can put it back before taking it to the dealer. There have been cases on the JK forums where people have forgotten to go back to stock and had their dealership flag their vehicle as having an unauthorized lash. Then every dealer they take the vehicle to uses that to try to deny warranty claims.

I dont think it will take tons of money or time off work. You MAY have to sue to get reimbursed-have the Magnuson Moss Warranty Act in hand when you go to court-but they may settle. More importantly is standing up for your rights.

The point is simply to make it invisible to the dealer and then there are no problems. My Superchips tuner for my JK is undetectable as long as I flash back to stock before bringing it in. I would hope that would be that's case with the DiabloSport as well. If its not, I won't be buying one.

It's been my experience that as soon as you mention the word lawyer peoples assholes pucker and you start getting results immediately. For thosr willing to atempt to call your bluff a nice inexpensive letter fired off by your lawyer usually puts all doubt aside in their minds that you mean business. Only in cases where the dealership truely believed that the after market part caused the malfunction would they further pursue the case. If you decided to proceed to trial it is still their (the dealer ship) obligation to prove beyond a resonable doubt that the after market part did in fact cause the issue at hand. I would think that unless the customer was trying to scam the dealership, that the issue would never get to trial. However if it did and the customer won then the dealership would more than likely be responsible for court costs and legal fees as those would be part of the lawsuit.

Remember folks these cards all have the ability to record your driving habits so no matter what if a part breaks due to you utilizing the vehicle outside of its design parameters it will not be covered under warranty. Just because they can't see the tune doesn't mean they can't see that the valve train turned loose at 8000rpm. It doesn't take a rocket scientist to know that an 8000rpm redline wasn't part of the original design parameters.
