Oiled performance air filters usually flow a slight bit more, but don't trap as much dirt, and have been known to coat the MAFs or intakes with oil if the air filter is over-oiled after cleanings. An additional cleaning/oil kit is needed to clean these filters.

Dry performance air filters flow a slight bit less, trap more dirt (flowing less & less as they do, requiring more frequent cleanings), but don't require any oil. Cleanings require only a vacuum or just soap & water.

I've used both in my past vehicles, and prefer the dry filters since you never have to oil them.

They have to prove that it caused a issue, if you sucked up water into the engine they would not cover it, but that is pretty much it, or if you over oiled the filter and ruined the mass airflow sensor.
