Wheel well liner torn, not under warranty?

My 14 SRT now has ~4k miles on it and we got our first real snow...
I am fortunate to be able to wash my vehicle whenever I want in a heated wash-bay... we are on day 4 of the covered snow and I have sprayed the Jeep off twice (this snow really likes to pack onto the factory tires and in the wheels wells... plus INSIDE the wheels)

Anyway, I know being able to, and doing this is very uncommon. So I of all people should not have this problem since I unlike so many others can get all the crap out of the wheel wells so often.
Tuesday was the second time of spraying off the Jeep during the snow and noticed my Drivers Side wheel well has been chewed up by the tire. I assume either snow packed on the tire made contact or somehow snow got behind the wheel well (entered from the grill) and pushed the wheel well in towards the tire which let it make contact.
Regardless of how it happened, I called the dealer I bought the Jeep from and scheduled an apt for yesterday (wends). I brought it in and they cant cover it under warranty due to thinking it will get kicked back/ charged back as not a warranty item.
Explained to them it can be described as a factory flaw- I.E. push pin not installed all the way led to the wheel well sticking out to0 far and tire making contact- wouldn't do it.
Tried another dealer who is not in the middle of a audit and they want me to stop by today to have a tech look at it (techs all gone and they need to make sure vehicle wasn't hit/ ran over anything to push it up- which would be my fault and I understand)

The part from them is only ~$120 plus the rivets (and tool I would need) and I have access to a lift so it would be no trouble for me to put it on... but its the principle... I think it should be covered under warranty..
Has anyone had this happen?
What was your resolve?

As long as you didn't modify anything that would have led to the problem then it should be covered.

If the dealer agrees to cover this you're lucky because it sounds like it has nothing to do with a factory defect.
Sounds more like damage from mother nature or road debris.

If they cover it under warranty it is a gift. Anything could have been picked up by a tire and done some damage, not realizing how special the OP is.

Jeep is going to replace it under warranty.
The deciding factor: At the bottom of the wheel well inserts where it attached to the bumper via 3 screws (that go into speed clips) on each side... No screws and no evidence of screws ever being there!

BOTH SIDES!

Might wanna check yours. I noticed while having the vehicle in the air doing my rear air suspension
