This whole thing is just a colossal Charlie Foxtrot.

Doesn't seem like that should total it... What's the repair estimates and what are they offering you for your Jeep? When my wrangler got rear ended by a full size Chevy van @35-40mph it was jacked up pretty good. Their insurance wanted to total it and give me $3k!!! They have to give you "fair market value" for your vehicle or return it to a "pre-loss" condition. I shopped around for wranglers in my area for sale and put estimates together for all the mods/accessories on my Jeep (lift, body armor, bumpers, wheels/tires, motor work, transmission, drive lines, gears/lockers, etc). When I was done compiling what it would take to buy another Jeep and put it to where mine was the cost came to around $13k w/o labor. Their insurance decided to pay for the repair and not total it after that... And they had to pay me for the loss in resale value for being in an accident (~$2500 if I remember correctly). So if they're really going to total it out, be sure to get your fair market value, not just what they tell you it's worth. Gather prices for comparable WK's, get estimates for all the mods and work you've done or had done, it adds up. And if it's still going away, shoot me a PM, I may take your TB off your hands!! Haha!

I have been trying to get loss in resale value on my bmw for two years now. They keep saying they are evaluating and denied it once but I sent them more legal documents and now they are reevaluating. They owe me 10k on it...

What would you recommend for the first major upgrade?

Well that would rule out special mods but then again he has the possibility of better tuning thru SCT
