Courts always give exclusion clauses the narrowest reading possible, and where there is any doubt the interpretation most favourable to the consumer is adopted. An exclusion clause will generally not cover a breach which occurs outside the 'four corners' of a contract, such as where a trader does something that was not authorised by the contract.

Where a trader has attempted to limit or exclude liability of an implied term a consumer should seek legal advice as the law on this point is both complex and uncertain.

I tried and took legal action out against just about everyone at Jeep, however even with my dad owning a law firm it was still cost prohibitive to go any further when in the end they offered to fix the issue..

I find it strange that chrysler jeep wrote the insurance warranty book
Its illegal in australia for any one other then a licensed insurance broker to provide insurance advice
So why is the insurance company not giving the advice?..

There is a another thing about extended warranties that can increase cost, and that's all the electronics. Lets face it, the vast majority of cars that have a niggling electronic issue after coming out of warranty, don't get it fixed . My boat is full of bloody electronics and there is 3 or 4 things wrong, but none of them are critical, and certainly not worth the $1000+ repair bill each. If it were in full manufacturers warranty, I'd be down to searay telling them to fix it under warranty.

Therefore my standards are much higher under warranty, and I get stuff fixed I would normally live with, so the cost of providing a full bumper to bumper is very high.

I'm more concerned with a common rail failing, or a sealed transmission complete failure - big dollar repair items that effect the utility of the vehicle.

Your comments interest me. I can only state what was told to me by "John" the Warranty Administrator in Melbourne on 1800505000. I will be following this up. Hopefully I may be able to post a response. I was asking him questions about this booklet the dealer gave me.l When I was at the dealership they pointed out Johns contact details and ring him with any questions. John was aware of the booklet. He had a copy of the booklet (along with every other car manufacturer etc that they warranty for) in front of him but when I got down to the details like I have already explained he said that this book was written by Chrysler and provided to them so I would need to talk to Chrysler for inerpretation of some of the clauses like the one I posted here. Interesting isn't it.

If it was ever in court I dont think the insurance company could say they did not write the booklet. But it doesn't really matter - the insurance company is bound to the australian consumer laws and they will overwrite the booklet in any clash.

Comes down to a question of cost. I have had a couple of mechanics say the JGC is a nice car but they would not own one out of warranty. Not exactly a glowing reference !

I would like to think that "owning a Jeep" "out of warranty" was based on experiences with the pre MY11 models! Otherwise, what the hell am I about to do?

Had exactly the same thing said to me. If jeep want to build the brand, the easiest solution is to provide a 6 yr drivetrain warranty with all new vehicles . It takes away that risk, AND it communicates a confidence in their reliability.

Horrifically expensive extended warranties actually make me more nervous.

I don't have mechanical knowledge. but isn't the the car built on a drive train already on a proven vehicle like an ML350 merc or something?

Guys, The Hills are alive with the sounds of.....MY14s!!
A beautiful sight. A batch arrived at Castle Hill NSW overnight. I took several photos. Strange thing though is that there's 4 Summits. I thought Oz wasn't getting any?? 3 White and 1 Black.

Keep your pants on. They're only Limited and Laredos. Just thought I'd give you a good morning wake up call. Good Morning!


P.S. The Jeeps are really in - just no Summits.
