Ok, I'm jack if the "two weeks" theory, and also sick of being told the standard car industry line " sorry we have been unable to replicate the fault, so therefore we cannot fix it".

My question is, how far is everyone willing to take this? CJA needs a serious kick up the butt, and I'm thinking this can be done in a very loud, and public way if we do not start getting some decent resolutions to our concerns.

I have a hearing with the CTTT in NSW in a couple of weeks, I'm happy to be the test mule for the new Aust cons laws, but what may help in this situation is names, and rego numbers, from anyone that has had this fault occur along with a description of when and where it occurred.

My vehicle has many other electrical issues that will justify a refund, however, I still love the car and what Chrysler to fix the 4wd issue, so that I can then consider replacing it with another jgc, if they don't, there is no way I would buy one again.

The 4wd service issue has now been accepted as part of the issues to be heard, but it would really ram it home if I could provide more evidence to this being a wide spread issue.

If you are willing to provide the information please pm me, I won't provide any info to jeep, just the judge. More of an FYI, this is how they treat their customers.

show them this thread and the one in troubleshooting... there are PLENTY of people with the problem.
there isn't much 'proof' of the problem that would hold up as pictures of 2 sunken rear wheels could be played off as 'driver error...
i really don't know if the ACCC is going to get you anywhere but worth a crack. we may just have to wait it out

Not the ACCC - the correct body in NSW as Gribbs notes is the CTTT - Consumer, Trader and Tenancy Tribunal.

As I understand it, in a nutshell the ACCC is a federal body that administers the Competition and Consumer Act 2010. I understand they will take legal action in their own right but really only on a national level in respect of a matter that affects many consumers. Think of a national recall of a dangerous product – say a Chinese imported car with asbestos in it!

In NSW the consumer authority is Dept Fair Trading - they mirror the ACCC for state based companies – say the local plumber who has flooded your house. Again, they can make representations on a consumer’s behalf but ultimately are a toothless tiger in my experience.

If you are unable to resolve your issue direct with the company or through the representation of the DFT, then you are able to take action through the CTTT (in NSW – I don’t know what it is in other states). The CTTT is effectively a court of law, but they deal with small consumer matters, initially through conciliation. If conciliation is not successful, it can move to a hearing. Orders of the tribunal are enforceable.

I’m no lawyer but this is my understanding.

Gribbs may be able to shed more light as he seems to be right in the middle of his action.

Gmwk2 you have explained it well. Although if we get enough unhappy owners with the same fault, we can go to accc to request the minister for transport to enforce a full recall on the jeep, this might force Chryslers hand into action

I'm aware of this, but the fact that the thread proposing to petition the USA has died means the chances of getting enough people is remote, even though the ACCC have a simple on line submission form.

I'm not one to give up on my legal rights that easily. I'm also not going to beg people to provide any info or join the cause. The way I figure , is you can lead a horse to water, but .........

I have spent many hours researching and document legal presidents, the ACL and sorting out my case. I'm just trying to provide my experience in order to save others getting 6 months down the track and then saying, I wish I got involved, or I wish I lodged that application.

Anyway. To date I have 4 vehicle details, the more the merrier.

Gribbs, Having a had some dealings with Fair Trading NSW and the CTTT, if you are going to bring up the issue of getting stuck in sand, you will need to produce Stat Dec's to the court for those persons willing to be listed as owners suffering the same issue. Alternatively, those persons would need to appear at the tribunal. It is not as easy as you may think. Also, bear in mind, the complaint you have is between you and CJA, so issues with other owners may be tossed out as being irrelevent to your case. The judge may very well dismiss other persons issues as Hear Say.
Also, you may find that the CTTT has very few teeth to enforce its findings, and that if CJA default, it is you who will need to take them to a higher court to get results. What may work in your favour is that in some cases, the other parties tend to try to reach a settlement the morning of the hearing, in order to avoid the cost of solicitors. Good Luck.

Thanks ally, this will be our second hearing. We have photos of all our break downs, and of the lights on the dash. Where jeep has failed is that they have not lodged any evidence that they wish to use in the trial. I think they are hoping they will be able to say they have resolved the issues prior to the hearing.

Previously I have found Cttt quite good. They have always enforced the letter of the law provided the evidence is provided.

Went to North Stradbroke Island last weekend.

3.6L Laredo
Standard Suspension
Standard wheels & Kumho tyres (22psi)

Had a ball! - No dramas at all with any error messages. Used a combination of Auto High, Auto Low, Sand High and Sand Low.

Towed a trailer and got bogged once - driver error! (It was my first time ever on the beach and off-road)
