Basically here in Perth the Department of Commerce, Consumer Protection is a conciliation party ONLY with no powers in enforce any party involved to do anything, Can only guess that it would be the same in the other states?

So in a perfect world where you would get together put the problem on the table and come up with a solution it works great.
Unfortunately in the world we actually live in, if one party disagrees and refuses to even follow the Law, the Department is powerless to do anything and it then needs to be taken to court for a Judge to give a verdict on!

So the Legislation is there and correct, it just can be a very long and expensive process if someone does not wish to follow them!

Considering the larger companies would have a legal department on staff, the like of John Hughes would only be too happy to give them something to do, where the normal Joe would have to find and pay someone and cross their fingers that they good enough to get the job done!

I know there is only one other option that I did not mention earlier and that would be to take it to the Media! I am sure John Hughes would love the story run on prime time TV informing the public to the way he wishes to do business and contradicting the all TV adverts that he must pay a fortune for
Only problem that would me sticking my ugly bloody head on national TV too and that aint going to happen

Christ Mark I really do feel for you mate , I wish I was rich mate I would personally give you a lawyer ,been down the road your on years ago with Ford and that was a nasty outcome . The thing that gets under my skin these days is you pay good money for something and doesn't last then you have to fight tooth and nail for the item to be repaired or money back . God I could go on for hours about this , anyway mate good luck and chin up

Well that's the problem - You pay bloody good money for something and you should get what you paid for!
There should be no reason to pay big money to get layers involved

As I said to John Hughes, it is not that I have changed my mind after buying it and just looking for excuses to get out of it - the bloody thing NEVER worked from day one and was quickly dismissed by his sales staff.
ALL I WANT is what I paid for!

As the Law states -
"Implied warranties require vehicles sold to:

Be of acceptable quality;
Be fit for the purpose for which they were acquired;
Correspond to any description attached to the goods prior to the sale; and
Correspond to any sample of the goods that was offered to the consumer prior to the sale.
The main warranties are those guaranteeing the acceptable quality of the goods, and their fitness for purpose.

For a new vehicle to be of acceptable quality it should be free from manufacturing defects for a reasonable period.

If a vehicle is not of acceptable quality, you can request that it be repaired, replaced or can ask for a refund"

So does not take a Rocket Scientist to work out my Vehicle is NOT fit for purpose, does not match any description attached to the goods prior to the sale and does not Correspond to any sample of the goods that was offered to the consumer prior to the sale!

It also states that Manufactures are required to carry spare parts LOCALLY!

But all of that means nothing

A client of mine had a "lemon" Dodge Journey - left his missus and kids stranded in peak hour traffic a few times. He went through the CTTT (Now NSW Civil and Administrative Tribunal) and had his money refunded. I know it is a hassle but it can be done.

Here in NSW it is simple to lodge a claim on line to get the ball rolling. I went down this path when I had problems at delivery. It took a few weeks to come to the top of the pile but one phone call from the CTTT case manager got JA to move - In the end I did not have to proceed to arbitration.

Maybe a solicitors letter as well to John Hughes might at least show that you are no longer willing to stuff around.

Knowing what I know now, if I ever have hassles in the future online form get filled in day one. You can always withdraw it if issue gets resolved.

Mark, for whay its worth, id formally contact jeep au, and politely ask for thier assistance in sourcing a new vehicle. Let them know, that failure to comply will result in legal action, and also let them know if it goes downbthe legal avenue you will be claiming compensation for stress, and out of pocket expenses this situation has caused you. Give them 7 days to respond, then if nithing happens, go see a good lawyer and sue their pants off.

That is not correct, you purchased from them, not CJA. They are responsible for the goods they sold you, CJA is responsible to them.

It does seem as though Jeep dealers are quick to put a complaint back on to Chrysler and not accept their part in an issue. I had the same thing with my liftgate and car drifting left issue where when the dealer couldn't fix it 100% and he noted my frustration and quickly said we can take it further with Chrysler Australia if I wish. I was surprised how quickly he pulled this out. However what John Hughes said is a cop out and if anything it's up to him to take it to Chrysler WITH you and FOR you since Chrysler is not supposed to deal directly with the consumer. That is the Mr. Hughes' job.

Trouble is they ALL seem to have the same attitude?

I even sent through a complaint to Jeep US via the website only to be told that they don't get involved with matters outside the US and was given a local contact here in Aust, this was then passed on to Robert Lawson who does not even care enough to return calls? When you actually get hold of him it is - "Oh I thought every thing was sorted, I will contact the Dealer and see whats going on and call you back" but you NEVER get a return call

As said, I CC'd the same letter I sent to John Hughes to Glenn Jones and Tracey Ferguson (Jeep Aust) They were also CC'd in on the the following replies from John Hughes to myself and myself to John Hughes- But NOT 1 reply from Jeep.

Although it is a major piss off, I can accept crap happens with even the best things - but it is the way that the situation has been dealt with that has me both fuming and concerned about future issues if they arise!

Will go out to see what is happening tonight after work, one would have thought you could have almost completely rebuilt my Summit with working parts off the donor vehicle in the 4 days they have had the vehicles?
But I have a sneaking suspicion, that because mine is Warranty work paid for by Jeep, I would assume the dealer cant charge the same outrageous rates that they charge their normal paying customers, so mine is sitting there and getting working on between other jobs and the discovery of further issues may be just an excuse for not getting it finished?

Depending on what is said tonight, it maybe time to lawyer up on Monday and take some action that MAY get their attention

Fingers crossed I will SOON be able to stop my rants and start posting some positive things about the car

Good luck Mark , I think the lawyer option would be the go mate also Mark if I'm unsure on what to do I always ring legal aid for advice I've personally used them in the past to help me out or to point me in the right direction on who to call and what my rights are . But good luck mate ..

In 1973 my Dad just looked at a Mitsubishi Wagon at Mr Hughes' lot in Vic Park and right there and then Mr Hughes tried to railroad the Old Man into purchasing the car. I was only a 13 year old kid at the time but I thought that Mr Hughes' forceful behavior into trying to sell my Dad a car that he really didn't need was extraordinary. I'll never forget that.

That just shows the measure of the man (Mr Hughes).

Just had a message from DVG Maddington and they have finally found the issue.
The Nitrogen line had been crimped behind the seat belt fixing also causing a pin hole in the line - hence low flow to the pump and leaking Nitrogen.

They are now in the process of stripping the vehicles down to change the lines over. I have no idea where these lines actually run and how much stripping is required, but they say that they are HOPING to get it done by the end of the day!

1 simple little thing has caused so much bloody drama
And unfortunately also shows the level of QA/QC because this could never have happened AFTER it left the production line and should have been picked up at the Factory

On the upside I will FINALLY get my car either today or Monday and don't have to fight it out it Court.

Awesome...I really hope that they found the problem. It looks like you are only steps away and much closer to getting into your Jeep. I was feeling a bit negative about Jeep and Chrysler myself just hearing the dicking around they've been giving you.
