Yeah, I figured you could be injured by them. I've heard of broken noses. The manual mentions "rope burn" style skin abrasions.

My wife is actually fairly tall, about 5'10". I'm not entirely sure of her seating position, but I'm the normal driver (6') and she just leaves the seat in the same position, so if anything I'd say she sits back a bit.

Car wise, I'm hoping for a write off, but the assessor reckons about $10k damage so far. The front doors don't open properly though and they don't know why yet, so it's up in the air at the moment.

The assessor sounds like a knob... probably trying to tune your expectations down.

Ten grand and the doors don't open? I'd put a wager against that estimate!

It may sound a bit weird, but if you have a crash and have not sustained critical injuries, then you didn't want the airbags going off. That is an explosion in your face, legs etc... and if they don't damage you, then it is still one expensive bang.

I had a moment of dyslexia Fred, and saw $13k. I was worried about which amphetamine powered panel shop would be taking the job! At $31k, I think you'll find that the car will be written off unless it is particularly high spec. I can't see what you've got / had other than that it's a diesel.

Do you have "new for old" provisions in your insurance policy? Now is the (second) time to become very familiar with your PDS.

It's a Limited CRD with lux group II so fairly run of the mill.

I definitely have new for old, but reading the PDS this time around is the first time it's twigged that if I opt for a payout rather than replacement, it's based on market value rather than the new value. I guess that makes the decision easy, but I thought it would have made sense for them to offer their buy price as a payout, regardless of the market value. Maybe they would negotiate on that when the time comes if I decide to go down that road.

For them the purchase price is a tax deduction so they effectively buy a new car for 30% less.

Thanks Bob, that's interesting. So technically it would be cheaper to replace it with a new one than pay me out for the market value of the old one, which was probably around $50k.

Maybe, maybe not, the payout is also a tax deduction for the insurer. It's all swings and roundabouts depending on cash-flow, fiscal timing and price negotiations. Decide on what you prefer, put up the best argument you can and see if they bite. If they don't, you might entice them by offering something you don't care too much about. For example you might accept an easier to get colour or lesser accessories. Remember that despite what anyone might say, there is no such thing as not negotiable.
