Just playing devil's advocate. Maybe it had a large tool chest on it when he parked. He was inside repairing something and the tool chest would be back in place before he was back on the road. In that "made up" situation, who wouldn't just leave the basket the way it was?


After 20+ years as an insurance adjuster/investigator I've heard crazier stories than that ... some of them true.

Either one of you could be right. Regardless, back the thing in so people can see how far your car extends into the lot, fold the thing up before going in, put some orange flags on the thing, or park in a back-to-back spot taking up two spots! If it's not me collecting, I'm sure his insurance company will be paying for someone's leg injury when they cut behind his vehicle while walking through a parking lot and end up with severe injuries. That thing has SHARP corners too!

There is no clear cut answer here. Even if you get into court, two different judges could come up with different decisions. If your insurance company wants to help, they can certainly get you the info. But, they could take the position that if you don't put a claim through them, they don't want to get involved. You may even be able to request the info (for a fee) through the DMV.

It's funny, because I see these all the time with nothing in them. Many of the local fisherman have them set up to easily carry all the gear. They take the gear off, but the racks stay put.

I agree. It could go either way. A lot of me putting this here is to get insight from others. Bill_de, I appreciate yours because you do play the devil's advocate.

I used to work as a first mate on a walleye charter boat on Lake Erie. Back then, fishermen had them too. My boss had one. However, he always backed in and when I would drive his truck, he insisted I do the same. If we weren't using it, it came off the truck. But always, there was something (empty cooler or tub), that was strapped to the platform to indicate more than just a basket platform.

I mean, I was in Vegas last week. Maybe I'm still in the gambling mood with the small claims court thing, but who knows. If I could just call the guy, for all I know he'd say "if I pay you half, can we be done with this?" and I'd gladly say sure.

Regarding the insurance company. They are my last hope and told me they would look into who owns the vehicle.

Because this happened in a private lot, without injury, and less than $5k damage, the police won't make a report.

Because the police won't make a report, the DMV won't provide owner information.

Because neither the police, nor the DMV will give me owner information, I can't even attempt to resolve this with the other party.

Online pay-for-plate info sites are pretty much all gimmicks with outdated information and people end up with unwanted recurring "membership fees" and spam.

This leaves me with the insurance company. I sure pay them enough as it is. It would be nice if they could help me with owner info. I'd gladly sign a waiver disclaiming liability on their part.

That would be the ideal outcome. Well, either than him paying for the whole thing so insurance doesn't have to be informed.

Things have probably changed since I retired. In NY individuals used to be able to request the info directly from DMV. Also, you could go to a precinct and make a report, just to establish a PR#.

Now I guess everything is considered private information, unless your name is Google.

Maybe the way to do it today is to post the plate # on FaceBook and ask if anybody knows the owner.

Bill, let me ask you this. Wouldn't it be a better idea to try to get in touch with him directly first, as opposed to making a report? I mean, you most likely want to avoid having insurance find out especially bc of carfax and such..

If you can track him down ... yes.

If a shop writes a computerized estimate it's possible carfax will get it anyway. Some of these computerized systems are tied into databases that track all this stuff. Depending on state rules, some generate a report for NICB (National Insurance Crime Bureau). When Carfax started they didn't have access to that one, but I've heard rumors that they do today.

Well, if that's true, then that would totally change the game as we know it. In an awful awful way.....

So, there is a chance that when I had my car fixed bc the garage messed it up, that if I ran a car fax it could possibly show up?
