Bill_de and Weck,

Thank you again for the education. I had to open a claim and withdraw it to get the info. I recorded the conversation after determining where the agent was and that it was legal. I was told that a report would be made internally within the insurance company but it would not be shared nor would it have any impact on insurance rates even if I had another incident.

Regarding the police, no report was (or can) be made, however, I have records of the calls made to the police regarding the incident.

As far as the other guy goes, he seemed willing to look at the pictures and to an extent admitted some liability while loosely denying it later in the call. I'm hoping he will give me a call by Wednesday as promised and that we can work something out. Honestly, if the situation were reversed, I would apologize for the situation, and settle on something fair.

I was actually thinking about that. They were pretty good about the whole thing. Now I just have to double check now and then to make sure they keep their word.

For anybody curious, I said I would update. The other parties' insurance denied my claim. I filed a small claims suit. I have been contacted by their insurance company's lawyer who claims he will be removing the case from small claims. He has not done so yet. Since filing the suit, the period of time for an answer has passed and I will be filing an application for Entry of Default Judgment. They will have 10 days to respond to that. Also, interestingly, I received the attached letter from Judge Judy lol. If anything else happens, I'll let ya'll know.

I have an email in to the Judge Judy producer asking to review the contract. She hasn't responded. The Defendants' lawyer did remove the case to regular civil court and so now I am battling there. Hopefully the producer of Judge Judy doesn't know that. If I do somehow end up on JJ, I will let you know when it airs. If I find out any information on compensation for the JJ show, I will share that as well. Wish me luck, it's me vs a real lawyer at this point.

So, what was initially a small claims case is now a "full on" Civil case? I didn't know they could do that (not that I know anything about small claims anyway...).

Did they do that simply so that their lawyer could do the talking at trial? Is this process now going to be more expensive? I suppose you need a lawyer now as well, yes?

If you file in small claims court, it is supposed to be without lawyers. Since you are the one who filed the claim, I do not think he has the right to move it to civil court. I would check with the county clerk and find out if he has the right to do this. The purpose of small claims court is to keep the lawyers out of it.

I agree with this.... all of this seems like a bigger hassle than its worth. A Mopar Fascia is only like 130 bucks and the chrome part is only 30 bucks....OEM. There has got to be a way to repair your damaged upper fastener on the cheap. These parts generally just snap into place. Where they don't, its usually a plastic rivet.

I know its a new car, but at least with a Jeep, its generally super easy and relatively cheap to fix. My wife damaged the front bumper of our Audi against our stone garage. just a little ding through the paint and into the plastic in the same location as your damage. I cannot find the replacement part cheaper than 500 dollars.

I say fix it and move on, its not worth disrupting everyone's life. It was an accident, leave it at that. Sometimes sh*t happens.

For my own curiosity, can you post a photo of the damaged fastener?

Keep in mind that, if he's on disability, you won't be able to recover much of anything unless his insurance would pony up the money on his behalf.

Disability benefits are protected from garnishment. That's also probably the reason he's reluctant to pay anything. He probably has nothing to offer.

Also, I believe you said you were a law student. You'll learn that not all suits are decided in accordance with the law. You have to keep in mind that you're a younger man with a brand new Jeep Grand Cherokee and you're suing a disabled man because his chair lift got in the way as you were backing out. You're not the most sympathetic of plaintiffs in this situation. They will play the disabled man and poverty cards. You want to stay away from any trial. Get this thing settled.
