DEALER tried to do one on me on Extended Warranty

So here's the story:

- Purchased the JGC that was owned for 6 months from a dealer (Dealer A).

- I looked around in purchasing a 7-year/115K KM Mopar Extended Warranty.

- Went with the lowest quote from another dealer (Dealer B). Issued a receipt for my payment of CAD $2,940.00 tax inclusive.

- Never received the paperwork on the extended warranty for over 2 months.

- Called FCA to request for my paperwork for the 7-year/115K KM, and was informed the vehicle does have an extended warranty, but for a 5-year/100K KM extended warranty.

- Here's the catch, this 5-year/100K KM extended warranty was purchased by the original owner of the vehicle from dealer A. So what dealer B did was to simply transfer over that warranty to my name - which we all know could be done FOR FREE.

- None of the dealers told me it had an existing extended warranty for 5-years/100K KM that could be transferred over to my name in the first place. And with that dealer B took my $2,940.00.

- So now I'm furious and called dealer B and since the guy I purchased the contract from is on vacation, they will discuss with the manager and call me back by today.

Thoughts?

With the disclaimer this could be an honest mistake [hah!] you might want to just leave the answering machine on and don't bother staying near your phone.

Small claims court. Here in the US anything under 10k is small claims and doesn't allow attorneys. Be real easy to show that they scammed you rather than informing you about your vehicles existing extended warranty.

Curious if this would classify as fraud. Dealer B took your money for a product that was knowingly not available

Thanks for the laugh guys.

I mean it's $3K. No attorneys need to be involved. I just want them to own up to this "mistake" and give them the benefit of the doubt even if after talking to FCA they mentioned dealer B applied to transfer the existing extended warranty under my name. And I never received a call saying, hey your vehicle has existing warranty we can save you some money. Instead it appears they took the money and ran? Again for $3K?

In any case, while I was typing this I got a call back and said they will get back to me on Monday. The person who got the brunt of my frustration over the phone earlier told me my story checked out as he was researching further (since he wasn't the original salesman of the extended warranty).

He will talk to the General Manager on Monday (as he is away for the long weekend) and will ask for a refund. But he cannot be certain until he gets the okay. I will update on Monday as I hear from them.

Please keep the suggestions and laughs going in case the GM says otherwise.

An extended warranty would have been a good selling point for Dealer A. Hard to believe the salesman dropped the ball like that.

I know right? SMH.

It appears both dealers don't care if the vehicle has existing warranty because they can cancel it just like that and then sell another.

FCA should know how to police things like these.

Simple mistake? It sounds like the dealer knew their was already an extended warranty on the vehicle but charged him a few grand for one anyway. That's not a simple mistake, that's fraud.

Simple mistake? They transferred the existing extended 5 year warranty to my name and took my money for the 7 year I supposedly paid for.

That was last April. For almost $3K. If I never called FCA directly I wouldn't have known what happened for this "simple" mistake.

Getting screwed is them not telling me there was an existing 5 year warranty, cancelling it outright, then buying the 7 year.

This is one more level above, it's fraud. And people who get away with this kind of attitude and brush it off at a simple mistake is the reason why we have @&@& up people in this world.
