Good info to know about the head restraints, maybe I can at least reset mine so that I can drive this thing. Their insurance company put it up on the rack today, and stated that the frame was bent at the receiver hitch(duh), but they want to pay to have an actual CJDF dealer open it up to see what else is wrong - as they want to fix it.

Well, for many insurance companies many/most accidents that takes place on private property (including parking lots, etc) and not a public road are automatically treated as no-fault...and each insurance company pays for its own insured. So unless she had insisted upon taking the blame or there was overwhelming evidence this is how it was going to happen regardless. Now, often times the insurance companies will go back after the fact and subrogate, but from the driver's perspective it's "each on their own."

True, except my truck was parked on a public street (curb side), in front of our condo. I'm working away on my computer and I see my beloved 4Runner jumping ahead 10 feet and hitting our fence. The car that hit it was a 90's Thunderbird that I couldn't see through/above the fence. She claimed that someone had hit her from behind, forcing her into my truck at 45mph, and then left the scene. Without any way to prove her claim inaccurate, the police didn't find her at fault.

wtf? did she have fresh damage to her rear end suggesting she was actually hit and pushed into your ride?

That's true if both car have collision insurance. The fact is, in states that operate under comparative negligence rules, most damage claims are handled by collision (first party) coverage and then the companies subrogate. It's a lot quicker and you don't have to wait for a liability decision to be made. If one or both parties don't have collision, they put a claim in with the other party's carrier. It doesn't really matter where the accident happens.

Glad that there were no serious injuries.

I got rear ended 18 months ago, shortly after I bought the Jeep, in stop and go traffic at low speed. The hitch took the brunt of the impact and all I ended up with were scratches on the plastic cover. Fortunately, no damage to the Jeep or any of us humans. Their car had a hole in the grill and some damage to the front end.

I had noticed that cars were getting closer to my bumper than I was comfortable with. After the minor accident, I swapped out the rear brake light bulbs with LED bulbs. LED is much brighter and comes on instantly. Since the swap, I find that most other cars are not getting as close to my bumper as they used to.

That being said, it's doubtful that brighter brake lights would have helped in this instance. My Dad likes to tell a story about a guy who ran into an ambulance that was on the side of the road with the lights flashing... he was doing something with his dog and didn't "see it". Goes to show just how blind we can be when distracted.
