That shouldn't be an issue. Uninsured/underinsured is for drivers and cars that have no insurance.

This is from Progressive's website:

Does my policy cover non-regular or temporary drivers?

If you have an individual that does not reside in your household and is not a regular driver of your vehicle, they will be covered under your policy contract. Please note that if an unlisted driver is driving your car at the time of a claim, you will be subject to an unlisted driver excess of $850 in addition to your standard excess.

If you choose to add this driver to your policy, the unlisted driver excess would not apply. It's important to note that any household member or person considered a regular driver must be listed on your policy for cover benefits. If that person is not listed, he or she will not be covered at the time of a loss.

Appreciate the info - I'll have to look to see if the same applies to here in the states, being that the info you quoted was for Oz - but if she didn't actually have insurance at the time of the accident?

Re: EcoDiesel got rear-ended this afternoon....

Research: the way the new Wisconsin law reads - irregardless if the driver has insurance, the vehicle is required by state law to carry insurance. State Law. And if the driver driver doesn't have insurance, property and casualty will cover up to $25,000 - but if the repair bill exceeds $24k the jeep will be a write-off.

Progressive is the one dragging on this - meanwhile I suffer. Time, money, use of my vehicle, invariably my insurance will go up irregardless of the whose fault it is, the holiday weekend....geez what headache.

Re: EcoDiesel got rear-ended this afternoon....

Progressive is the one insurance company that I won't have again. I know lots of people have it, but they dropped me after I made a claim on my '04 TSX.

I think you should get some clarification from your State Insurance Department. Even when it comes to your rates going up/or not usually is dictated by regulation. For example, (in NY as of '05) if your policy paid for your repairs, but were able to recover at least 30% from the other carrier, they could not raise your rates.

Here again the insurance companies partially side step by, not raising your rates, but taking away some discounts. It still costs, but not as much. Your state should have specific criteria for both rate increases and discounts. Know how it works and make sure you are not penalized when you shouldn't be.

Another thing that is typically regulated is the amount of time a company has to settle a claim. It is usually longer for third party claims because they allow time for damage and liability decisions to be made. If the carrier exceeds the limit without a good written explanation, that should be reported to the state.

I hope you have kept your company in the loop. If the car totals and Progressive's limit will be $25,000 you will need to collect under your policy.

I have.

Progressive refused a copy of the appraisal report, but I found it on their website:

Progressives estimate: $3747.44
No mention of the rear suspension, no mention of the hood, fenders or doors being out of alignment, no mention of the creases in the door/roof line, they want to pull the dent out of the rear lift gate and "repair" it, several parts are being listed as "remanufactured", reuse the decals/badging and the genius who wrote the estimate stated the color as light blue???? WTF - It's SILVER!!

The estimate I received from a CDJR body shop came in at $11414.64 - which is quite the disparity of difference.

More and more I am becoming increasing incensed with "Progressive" - through their actions my Jeep - which is not even one calendar year old(yesterday was its 10 month birthday) - is becoming a headache.

Yes I know its only a material possession - which can be replaced, but the POS insurance won't even do that. Sorry for venting here, but I am at a loss where to go. I'm 41 years old, have driven for 25 years without incident(29 if you include growing up on a farm) - NOTHING. Driven in every state except N.Dakota, Maine and Hawaii. I'm beyond disgust at this point.

Find a good attorney. You also need money to cover the dcrease in resale value.

Reread some of the previous posts. I CANNOT sue or try to recover "diminished value" here in WI. Effective 2014.

I don't get it, it's like, if Progressive is wanting you to have a go at them! How can they just come up with $3747.44 of damages! IMO, That would not even cover labour to fix it!

At some point, the will fork up the cash to repair it, and must do so and to your satisfaction. I know it's easy for us to write all these comments, but I really do feel for ya...again, hope it all works out

To be honest - the comments are have been very supportive, and I appreciate the help. Makes me feel a little less alone. Progressive is trying to cut corners where they can in order to save the expenditures. I get it - they're a business, in business to make money. That being said, when it becomes blatantly obvious of that - I lose all respect.

One quote I received from a CJDF dealer shows replacing the whole exhaust- @ MSRP that is $690 for the left side and $1780 for the right - those two parts alone account for more than ⅔ of progressives quote, without accounting for ANYTHING else.

Progressive policy is "7 days" for complete resolution. I can wait until Monday @ 1130am cst - when they originally contacted me. If I don't have satisfactory resolution by that time - I take it to the next level, and it's gets expensive real quick - None of it will be on my dime either.

Re: EcoDiesel got rear-ended this afternoon....

The reality is even the high quote is probably too low. Once they get it all apart they will find more damage. Body shops always low ball so they get the job instead of the car being totaled. Isn't progressive on the hook for the total repair? If so they should give you the ok to start the repair and pay the bill at the end. What's the point of the estimate? They won't be right anyways.
