On the hook for the whole dime, plus the fire extinguishers used, plus my sons Britax car seat, plus the rental. I'm sure they chose to delay in an effort to: 1) get me to use my insurance and subrogate, and 2) not have to pay 2 extra days of rental.

Don't be concerned with the estimate you found online. Here's what happens. The adjuster goes to the shop, one of many stops that day. No matter how long he spends there he will not have a complete estimate until the shop pulls it apart. Because the estimating systems that most companies use today have a big brother feature, the adjuster can't just tell the shop, call me when you're ready for me. The adjuster has to feed the system before leaving for his/her next stop to account for his time. When he gets to the next shop and starts a new estimate, the system calculates his travel time and puts him back as writing an estimate. Your shop will get a copy of the estimate when they have agreed on everything they could see after the car is torn down. Even after that, it is common, almost mandatory on a big loss, to go back and write supplemental damage. Keep in mind, they won't be able to test all of the electronics until everything is powered up again.

I obviously can't speak for everybody, but most of the adjusters I've known and worked with do try to do the right thing. And a large majority of customers are satisfied once they can put it all behind them. Even knowing that doesn't help until you get there.

In the good old days thing could be done with a handshake. No more.

BTW - in some instances used parts may be preferable to new. A new door is just a shell. All of the undamaged parts get taken out of your door and transferred to the new one. A used door that was never hit was assembled in the factory. Either on is going to be painted in your shop.

Before you let this get you too excited, see if you can talk to the adjuster. Initially at least, don't tell him what you want him to do. Ask him what he plans on doing, and then if you feel he needs to do something differently talk to the shop about it first. The adjuster probably knows the guys in the shop if he's been around awhile. Unless one or the other is a dirt bag, they should be working togetherto get the car fixed.

I have always gone through my insurance company vs the other drivers. You aren't guaranteed the deductible but I always get it if not at fault.

Same for me. Ironically, my insurance company is Progressive (for many years) and they have done well by me, including putting out $26K to fix my previous vehicle after getting "sandwiched" after having to stop abruptly on the Interstate to avoid another vehicle that was clipped in front of me...subsequently getting rear-ended by a big Caddy and pushed into the stopped vehicle in front of me. I let my carrier sort it out and didn't even speak to the other carrier (State Farm) on the advise of my insurance provider. (PA is a "no fault" state so there may be some differences in how things are handled elsewhere)

I do hope you get this settled, Jason. I really don't like it when folks get the run-around, especially when they are not the at fault party.

Like most No-Fault states, Pennsylvania's no-fault pertains to payment for injuries and has nothing to do with getting a vehicle repaired.

"Pennsylvania is one of a dozen states (plus the District of Columbia) that uses a “no-fault” system when it comes to financial responsibility for injuries after a car accident. In a no-fault state, a driver usually turns to his or her own insurance policy to get compensation for injuries up to the personal injury protection (PIP) limit, regardless of who was at fault for the accident."


I do agree, if one has collision insurance, it is almost always better to use it, rather then put in a third party claim.

Yes, correct about the liability thing. That said, I always would let my carrier handle things...that's what I pay them for. In the previously mentioned accident, I was on the hook for the deductible at first, but once the at-fault party's insurance paid, I got that back.

I don't know why your insurance does not do this work for you? (I might not catch it from earlier posts)

Does anyone know if attorney is needed or required in the small claims?

The whole idea of small claims court is to eschew the cost of an attorney and the plaintiff brings their own case.

Your insurance company can and will pay for an attorney to defend you. They (in most jurisdictions) are not permitted to act on your behalf as a plaintiff. There are a number of reasons, not the least of which is that attorneys would not stand for insurance company attorneys taking business away from them. Your claim reps should not be giving legal advice and can get in trouble for doing so.

That is another good reason to use your own carrier. To the extent they pay you, plus your deductible, they have a vested interest in the claim. Your policy, somewhere in the not necessarily small print, should state that either the carrier retains the right, or you give them the right, to subrogate.
