Physically I'm fine - no residual pain now 6 days after. Had no pain immediately following - the Active Head Restraints I'm sure paid a huge part of that.

I am done doing this on my own - I had hoped to have this expedited rather quickly as the 20 yr old the plowed into me was 100% at fault, admitted on scene to multiple witness and law enforcement, and was ticketed. But without a vehicle for a week has been a burden, and being yanked around by "progressive" has reached my limit. It goes to my insurance agent, and if necessary, i go one step above of that. I will be made whole again.

More details as they become available - I do really appreciate the advice and support. I've gotten more positive vibes here than I have from anywhere else - all of you should be commended, medaled or more. Thank you!

In this case, the person (who want to file a plaintiff) should include the other driver's name ? Or should it be directed toward the other party's insurance? I have same situation and I am having a hard time with all of that :|

I'm not sure of the legal things, but were it me, I'd likely list both the driver who is at fault, the vehicle owner and the vehicle owner's insurance...

I was in a similar situation as you once, only the accident was not as bad, and therefore the $$$ involved not as high.

Glad you found the route: even if you do not file a claim with your own insurance company, have them deal with the at-fault party's insurance.

Good luck to you, hope that you get everything you deserve from it, and can put it all behind you soon.

Jason, I know I mentioned it before but I feel for you on this man. You are 100% in the right here and you deserve to be made whole. I hope that escalating the issue gets you the response you deserve.

Have you thought about keeping track of how many hours you've been spending on this? It's probably a long shot, but as a consultant I would probably try tacking my hours on there at a pretty generous rate for all the inconvenience of being dicked around just to make sure they understand that my time is not free. Especially when it was their customer that hit me!

I experienced something similar 9 months ago when I was rear ended at speed (50 MPH or so) in a 6 day old Jeep Grand Cherokee (it was not a good day). There is a thread somewhere in the Export section but I do not appear to have the skill necessary to find it.
Anyway the following is a summary of what I learnt which may or may not be fully applicable as this occurred in Australia.

1. Insurance companies deem a vehicle to be a write off if the cost of repairs + the residual value (money they get for the vehicle in its current state at an auction) exceeds the market value of the vehicle. If the insurance company suspects that you will be difficult they may be more inclined to write the vehicle off.
2. The rear chassis rails are manufactured from High Strength Steel and cannot be hot repaired (all straightening operations must be performed cold). It was my understanding that the chassis rails must be cut and replaced in accordance with the Jeep Accident Repair Manual (copy available from WK2 jeeps). I suggest that you advise the insurance company that you will be getting an engineer to check that the vehicle has been repaired in accordance with the Jeep Accident Repair manual before accepting the repaired vehicle.
3. Damage to car was only really evident after the rear of the car had been stripped (removal of rear interior panels and bumper bar) for assessment. The insurance assessor took one look at the car in this state and deemed the car to be a write off.
4. In Australia there is no standard to which vehicle repairs need to conform to. However the courts have deemed that the repairs must be within 3mm of the original tolerances (vehicle manufacturers these days seem to have a tolerance of 0.1mm). There are companies that will conduct a laser scan of the repaired vehicle to check what the repair tolerance actually is. I mentioned this to the repairer and he advised that he would be reluctant to do the repairs if I was proposing to do this. Not sure if these services are available in the US.
5. The tow hitch attaches some distance back from the rear of the car, through the chassis rails and significant damage in the area was evident (floor of cargo area had a tear through the seam and was buckled).
6. The Jeep offers excellent protection in a rear collision. An hour after the accident I was back at work and other than a slight headache all was well. A colleague had been rear ended (on the same road) in a Toyota Kulger (Highlander to you) and was off work for a week!

Should also mention that my car was deemed to be a "Statutory Write Off" (registration papers are marked advising that the car has been written off which removes the incentive for the car to be purchased, repaired and then sold to an unsuspecting buyer). Took a few weeks for this to happen though.

Had a similar accident in '12, was stopped in traffic in an exit lane and was rearended by an F-150. Truck was a writeoff, my GC drove awayand tailgate still operated properly. 10,000 miles after repair everything is fine. Headrests also deployed.

Key to lack of damage is the factory hitch assembly.

Update: I got tired of waiting, and I turned it over to my insurance this past Monday. That same day my insurance set up an appointment with their adjuster to take pictures and gather my information-that afternoon I had it into a FCA Jeep dealer to get a new estimate done. Tuesday morning I was in a VW Jetta rental. 2-3 weeks to get my Jeep back. I need a shoehorn to get into and out of the VW.

There is nothing like a rental to make you appreciate your GC. I had a town and country minivan that smelled like a Tijuana hooker. We'd get in the thing and immediately have to put all the windows down. Not nice when it's 10F out. Good luck with the repairs on your jeep.
