Well, i'm not sure about in the States. But in Canada, a merchant has the right to refuse a particular form payment if they want. That includes legal Canadian tender even in the form of Canadian dollars believe it or not.

Businesses don't even have to accept cash if they don't want to. For example, they can say they don't accept any bills larger than a $50. Or they can say they only accept coins but not bills (such as some public transportation does).

So I don't see why it would be expected that a business must accept a specific credit card when they're allowed to deny specific forms of actual legal tender.

The decal on the window means they *can* accept of Amex. It doesn't mean they *will*.

It's pretty much the same in the states. There's no federal law about it; it's left to the states. And in most states (I wouldn't even know the exceptions) it's the same as what you described for Canada.

As a business owner it is my understanding that I can accept or reject any form of payment, on a transaction by transaction bases. It is within my right to refuse even cash payments for any number of reasons (total is too large, denomination of the bills, counter-fitting issues etc..). It is not common knowledge but cash costs more to accept then debit. Most businesses will pay a "cash counting" service fee that is greater than the typical debit fee.

I can even accept or reject payment-in-kind or barter as long as I pay the taxes on the transaction.

I do not and will not accept AMEX. Merchant fees are stupid and most people with an AMEX card carry another as backup. Wouldn't bother me at all to politely explain this to you and ask for another form of payment. Business is business if you choose not too finish the transaction that understandable also.

Awhile back I owned a retail business. I had the capability to take AMEX charges but never did, and I never posted their PoP signs. At the time MC and Visa were charging around 2% per transaction while AMEX was charging 3 1/4%. I can understand dealers not allowing full charges on automobile purchases. At 2% the fee would be $800 on a $40000 vehicle. At 3 1/4% that would amount to a fee of $1300 . Ridiculous at best. AMEX is no friend to small business.

There are some relevant state laws, but in general the rules are set by the merchant's contracts with the credit card issuers. American Express allows the merchant to impose minimum and maximum amounts, but only if those same limits are imposed on every other credit card. You can report violations at http://americanexpress.com/yourchoice.

I own a business and I take Amex. I can G.A.S about the extra point and a quarter. Do you quibbling clowns realize it is an extra $1.25 on a hundred dollar purchase to accept Amex?
For $1.25 they lost the service appointment I was about to make and any future service / warranty/ good will they might have received by spending the extra $1.25 to accept Amex. Trust me, it cost a lot more than $1.25 to bring a new customer through the door.

I am a big fan of AMEX, have two Platinum cards...a personal one and a business one. Amex has about the best customer service of any card company out there (unless you piss them off but thats another story). When you're traveling you have a lot of security, perks, etc. Great rewards as long as you're smart about your purchases, haven't paid for a plane ticket in years. Companion international airfare with business or first class purchases, free airport lounges, 24 hour concierge service, free upgrades when staying at hotels through their fine hotels and resorts program. Purchase protection, absolute protection from fraud. Absolutely have your back when dealing with merchants. Annual fees are high depending on the card but they don't have to be, but I make money on the cards every year despite them. Plus, there's a certain level of status that comes with them. Hey, I have a 1-800 # I can call to charter a jet. Which helps me out with all my jet chartering needs (thats a joke, by the way)

Now...if you're a merchant...they're a pain. Expensive, slow to pay. But, AMEX clientele is pretty high end compared to the other cards, and I personally believe if you're a merchant that wants to do business with folks who have money...not taking AMEX is not an option.

I've never seen a car dealership that allowed more than $5k to be put on a credit card towards a car purchase, at least not in the last 15 years or so. My Dad did that once when I was a kid, put a car on an AMEX to get the points, but I've been told during my last 4-5 car purchases that they have a $5k limit because of the merchant fees. I always put my down payment, taxes, first months payment and driveoff etc on AMEX for the points.

Never seen a car dealership that didn't take AMEX.

Fun memory:

Some years ago, one of my favorite local restaurants changed owners (fortunately they did not change cooks.) So for a week or so, they only took cash until the new owners got set up with MC/Visa - but the merchant was having trouble getting his Amex deal set up.

A party of businessman came into the restaurant and attempted to pay for their meal with AMEX. When the owner apologized and said that he was having trouble with his AMEX rep and wasn't set up, he was told curtly "that will be fixed".

You see I live in N Phoenix and AMEX has a large facility not too far away from the restaurant. Apparently the party was a bunch of company big wigs. The owner had his authorization that afternoon!
