In the USA, a rear end collision is an automatic invitation for a medical claim, even with very minor damage. Insurance companies will settle quickly for $20K, it's cheaper than paying legal fees and never-ending doctor visits for back and neck pain.

In 1999, I rear-ended a young woman, who turned out to be an insurance adjuster. In addition to a new vehicle, she received a cool $40K for pain and suffering. I am not saying she did not deserve compensation, but she knew every trick and procedure to maximize her claim. The insurance paid it all.

In New Brunswick Canada there is a $7500 soft tissue injury cap. It just went up this year from $2500. These caps are in place to keep people from making outlandish claims which in turn lead to skyrocketing insurance premiums.

She is actually making an injury claim for whiplash and whatever else but she will only get a max of $7500 towards her medical expenses and even then the insurance company can challenge it if they feel it's an excessive claim.

My jeep will be fixed good as new. She will likely end up with about $3000 worth of repairs and a massage lol.

Rear ended a Pontiac G6 today.

They enacted the legislation a few years back to cap claims on soft tissue injuries as a way to reduce the premiums insurance agencies were trying to charge. The ridiculous claims were an excuse for the companies to gouge customers.

Civil litigation claims arnt as big a business here as in the US. I see the personal injury lawyer commercials on our American channels. It's crazy.

Off topic as far autos, but what is CRAZY is the jury in Florida that awarded $26 BILLION as punitive damages to a widow of a smoker who died of lung cancer.

Addiction to ANYTHING should not be rewarded to such a ridiculous level. How could any jury be that unreasonable. They only provided more input for appeals.

We can thank our federal government for fostering the idea that a billion dollars is not that much money.

I don't believe any country in the world is as obsessed with civil litigation like the US. A burglar can sue a homeowner if he slips and breaks an arm in the yard while trying to get in through a window.
