My auto insurance will not be involved. For medical, I have to use my health insurance and then eventually get re-imbursed by the other driver's insurance for the medical when all treatment is done. At least that's what the adjuster told me. The driver who hit me was contacted by his Insurance company and he agreed to be responsible for the damgaes to my vehicle.

I had a similar accident in my previous vehicle when it was only a little older than yours. The air bags did deploy because I was pushed pretty darn hard into the car in front of us. But it wasn't totalled...insurance paid $26K to fix it. Fortunately, the hit was square and there was zero frame damage. No injuries, either.

That makes it easy for you since he admitted fault.

I got rear ended yesterday too. I was stopped at a stop sign and this small toyota car was coming very slow and wud not stop on ice. He skidded and hit the rear of my Jeep at a real slow speed. I could not drive away as there was cross traffic. So, I got out and looked for damage. None. He hit the hitch and got some nice scratches on his hood.

But guys, seriously... if you are not in any pain, wait a few days and see. No need to start suing people.

2 years ago i was stopped at a light in my Boxster. The light turns green for left turn (left arrow), the big 350 truck behind me hits gas and bumps me behind. We pull into parking lot, I call the cops, exchange ins info, he gets a ticket, etc etc. I had a slight headache after that (possibly because the idiot hit my Boxster. LOL). Anyways, I spoke to my doctor the next day and she told me to just wait few days and don't milk the system if I am not in pain. I waited 2 weeks.. no pain.. everything normal. Got the car bumper fixed (no cracks.. just minor scuff). Did not fight for medical or anything and I am fine so far. I believe in "ill got, ill spent" philosophy.

Adam, it sucks that you got hit.. that too on a new Jeep. Best part is you are ok! Keep an eye on the back and shoulder/neck area. If you start developing pain, then, please see a doc. You can then start claiming from the other guy's insurance. I just hope that your body did not get any impact due to the accident.

Thanks for the post! I think I will be fine. I think it is all in my head at the moment with the initial shock factor of the accident occurring. Sorry to hear about your accidents in the past as well. Good thing there wasn't any damage to your Jeep!

Not a good day for Jeeps. I hope all involved stay pain free.

To total a car, the general rule of thumb is that the damage has to be a least 75% of the value of the car.

Diminished value is different from state to state. To be reasonably sure you get a straight answer, contact your state insurance department. Even if they say it is not a mandatory payment, you could possibly negotiate something from the other carrier. Depending on the damage and the quality of the repair, there may be no diminished value. Some states will consider it if you sell or trade the car within a certain amount of time, and can document the loss.

As for your own medical bills, if any, are you sure you don't have "No Fault" for that? Most states have it as mandatory and it becomes your primary coverage for auto accidents.

And, if you have the name of the person who tried to "buy a release" for your injuries, you should make a complaint to Allstate's corporate offices in North Brook, IL. That is definitely not corporate policy, although some local managers do (too often) have people break the rules to make themselves look better.

Allstate does do one thing right, they send me my retirement check every month. I hate when they screw things up like that.

Mine was rear ended about 5k miles too, caused about 5k in damage. Lady hit us going about 35 without any brakes at all. My insurance guy said there was pretty much nothing you can do about deminished value because they are excluded both 1st party and 3rd party. Even said if he could sell me something he would. I've been with him around 15 years, so I sort of trust him. So I just kept on the other drivers insurance bringing up the whole made whole after accident argument. They will swear up and down they don't give deminished value checks. Eventually a 750 dollar check showed up in the mail for no reason at all. More or less hush money for me to sign I wouldn't sue the driver. Not sure 750 was enough, but I just ended it there. Just stinks you can't protect yourself from careless drivers. You will win in court for the made whole argument if you take it that far but sometimes that means selling the car to see what the value change really was. Tough battle on these for sure but keep fighting until you get something. I've also been told to not sign any checks from them. They cannot close the case unless you sign and accept their money. So if you have the means fix the ride yourself, don't sign any checks until its an amount you are happy with. They will eventually make you happy if it's left open long enough, much cheaper for them to dish out 1-2k than getting lawyers involved. Good luck though! Glad you were ok. Mine was like a tank when hit, very impressed.

I don't know anything about "No Fault".

Thanks for that info. about All State. The first person I told about that said to me that sounds like a bribe. I'm not happy about it and will wait and see how she handles my case. It's the adjuster that was assigned to work with me. I have State Farm insurance. The other driver with All State is where I will get all payments (auto body work and medical) from.

I haven't gotten an estimate on the amount of damage yet. I am sure that will come sometime next week. I am a little confused as to what you mean by the "whole made whole" argument. Sorry for my stupidity.

Sorry to hear about your accident. Thanks for sharing that info. about loss of value; that's one of my major concerns. I also won't be accepting the $25 per day rental which is like a Toyota Corola. There going to have to supply me a mid-size SUV.
