Nice. The All-State adjuster told me it will be through Enterprise. I'm not taking no for an answer either. I can still drive my vehicle and don't have repairs scheduled yet. Getting an estimate this weekend. Do you think I should get this worked out ahead of time? or the day I'm to get the rental?

If you can get it worked out ahead of time that will give you piece of mind.. but if the other drivers insurance company takes full responsibility they have to give you a comparable rental car to your car that will be needing repairs.

It's more or less legal talk for the victim has to be made "whole" for another causing them financial damage. Their version will be that you were made whole because you have your car fixed. However, you and they both know your vehicle isn't worth as much as it use to be because of the accident they caused. To be fully whole you need that extra check. Getting a few dealers to back you up may also help, just go in after a couple months asking to trade in and see how much they ding the value. After the carfax is updated of course. I doubt I would have sued the driver, I just knew I could get something so I kept pressing. Took me a month to get 750 so I just let it go, was driving me crazy. Just do all the homework you can, talk smooth and maybe even have your company press them. They will budge, how long and how much is usually the question.

Perfect. Thank you very much for the information. That is pretty much what I was looking for. It really sucks that this has happened but stuff like this happens unfortunately. I really hope that USAA will make things whole with the situation and I will not go down without a fight! lol

I also went through enterprise and got a liberty. Other option was a Journey. I live in a smaller town so they didn't have much of a choice. I was sort of ok with it, but it could have been better. They will make you happy though if you press for a GC I think.

Go through your own insurance company. They also know the dirty tricks & will be an advocate for you. You should get repairs, medical, everything submitted to yours & let them go after the other ins co. Good luck.

When I had my car rear ended couple of years ago, I did not even deal w/ my insurance. I went directly to the body shop that my Porsche dealer owns, got an estimate and told the other party's insurance adjuster (who called me in the next day) to talk to the body shop. I paid nothing from my pocket and the job was done in few days.

After 3 months or so, I got a call from them and asked if I had any medical problems. I said none and the lady then said she wud send me $500 for signing the release. I took the offer and got the job done. My good friend works at Travelers insurance and he said that I could have easily gotten up to $5k. But, like I said, medically I was fine and was glad my car was fine too. I had no intention to make $$ over the incident. I have pictures and receipts of the work done on the car and I don't think there is a major "diminished value" on a 13 year old.

The other person's insurance company also told me to bring in my vehicle for a repair estimate to their guy and I get a check that day. Is that the wrong thing to do too?

Should I get an estimate from my body shop first or after I get their estimate?

I wouldn't have accepted a check from one of their appraisers. More than likely they are going to low ball you to get you to sign a release of the claim. Working with insurance companies is like negotiating the price of your vehicle - it will work best in your favor to stick with a number. At least in my opinion.
