Ok today.....so far. See what tomorrow brings. Current estimate stands at $11414.36, and thats without even tearing it apart. Vehicle has a value of $34560, and they will total it if the damage exceeds 70% of the value - so I'm only half of the 70% at the moment. Those neat little active head restraints that saved me from whiplash are disposable after use, and are $504 each + the module for an extra $269. Complete new factory exhaust is $615 for the left side and $1775 for the right side....

I got two independent estimates done before I go to their insurance claims center so I can go in fully aware. I also wrote down the accident as I remember it, along with all involved parties names at the scene(law enforcement), plus I have 59 digital pictures from the day of, and map showing my actions/driving and contact info of the witness(who saw the whole thing in front of him).

What is Diminished Value ?
Diminished Value is defined as that portion of a damaged vehicle's pre-Loss Value that has Not been restored through the repair process. There are actually three (3) basic types of Diminished Value . . .My insurance guy laughed at me. Below is link>>

Yup- I actually poised that question to their insurance already - they said that I would be required to bring in a expert with a expert opinion and submit a claim, and they decide if they will pay it or not. I thought after they told me that this a perfect time to lawyer up......hate to go that route, but its 100% not my fault, but I will get the loss? NOT. GOING. TO. HAPPEN.

The insurance carrier of the person that hit me is Progressive - they want to do their own estimate to evaluate my vehicle. I got a estimate down at a CJDF repair center just to be prepared. Its a new vehicle, not even a year old, although it is one calendar year old. In the exact configuration that my WK2 is in, Jeep only made 5 GC's (coil suspension, no sunroofs, navigation, trailer tow, standard limited interior, Off-Road I, EcoDiesel, silver paint) for other customers. So finding a comparable replacement is nigh impossible, if they total it. If they want to fix it, then I have a Jeep with diminished value because of a major MVA - I get penalized either way.

Skip a lawyer. That'll cost you more than it's worth. You need a wholesale auction buyer or a retail auto buyer/manager to validate the diminished value.

Progressive noted today the unibody frame is bent/shifted at the receiver hitch, and the door lines have creases......and they want to fix it. I am not overjoyed to hear that. They did tell me to take it to any dealer/repair shop I wanted to

I did - personally - as my agent used to be on a volunteer fire dept with me decades ago. he said to deal with Progressive, unless I want to pay my deductible . Pretty discouraged after talking with him. Any which way I slice it I am going to get screwed over here. 30% diminished value loss.
