Dealer sold me used car as new

My first post but just wanted to get input from you guys regarding an issue I'm having with the dealer I bought my SRT from. Sorry this is going to be pretty long but I want to make sure I present the details.

I live in MD but I bought a "new" '15 in early September from a dealer in VA as a new car with 90 miles (a little high but not too unusual) on it including my test drive. A few days later I ran across a site doing a free autocheck and punched in my vin number just for the heck of it and saw it was registered and titled in VA in late July/ early August. I also thought to check the recent destinations in navigation and saw a single address listed that matched the city the car was titled/registered in. I immediately contacted the dealer and talked to a sales manager who was familiar with the situation. He explained to me that another person tried to purchase the car, did all the paperwork and drove the car home but his financing fell through the next day and returned the car. This is a common practice by dealers in evenings and weekends when banks aren't open. I was told the registration and titling paperwork should have never gone through and that they would get it resolved. I spoke to the sales manager again a week later and he changed the story saying the person never drove the car home, he instead started the process to purchase the car but in the middle of paperwork decided to get a different SRT on the lot but they messed up the vin numbers... I thought to myself BS because theres a residential address in my navigation that matched the title/registration event in Autocheck and Carfax. He said it wouldn't be until the end of September before all the paperwork gets cleared up with the DMV. I waited until the end of the first week of October and the Virginia DMV is still reporting a title was issued in early August. So I got in touch with the dealer again and was told they were still working on it but had a hard time getting a response from the DMV and said to check back on the 16th. I called back on the 19th and left a voice message and got no call back so I called again today and left another voice message and still no call back. I've always left voice messages in the past and he's called be back before this week and I know he's there this week.

What should I do now? The sales contract states its a new car but isn't the car legally a used car regardless of the miles until the title issue in VA gets fixed (if it ever does).

Hire a lawyer, or tell the dealership your hiring a lawyer, and see how fast they move. Honestly, I would try to get out of this purchase, and find yourself a different jeep from a different dealer. If they are this indifferent to you, it begets the question of what other shady deals have they done.

I agree, tell the dealer you're going to bring in a lawyer, and if they don't iron it out in a day or two follow thru with that threat.

If the vehicle was already titled once, then the certificate of origin is gone (the state that titled it should have taken it) and it is not a new vehicle. I wonder what title was used to register the vehicle to you..

Wow!!! I wouldn't have waited as long as you. I only trust what Im doing and not what others will do. Dealers don't care, its your problem to resolve the issue. Get a lawyer asap.

Sh!t move by the dealer, pretty low. In saying that the rig had under 100 clicks on the odo, as much as it might be disappointing if it's the one you wanted does it matter too much????

Push them for a bit of cash back and enjoy the ride bro IMO......

You're right... VA should have taken the certificate of origin when they titled it. I'm wondering what was used to the title the car in MD under my name. I believe I can go to the MD MVA and request the paperwork.

I don't believe the dealer knowingly sold me a used car, they are big name dealer in the area. The sales contract says its a new car, my loan rate is a new car loan rate, and got all the new car perks including the little SRT flag. But it bothers me this sales manager who was very helpful in the beginning is now ignoring me.

I'd rather not deal with returning the car. I like the car and aside for the fact that it was mistakenly titled for all intents and purposes its a new car. I would be totally content with receiving a bit of cash back and letting it go. Would the lawyer fees even be worth the hassle?

When I bought a new Limited back in 98 it had 245 miles on the odometer. It was what I wanted so my dealer traded another dealer for it. Most likely a demo. It was sold to me as new. Ironically, this Jeep went back under the lemon law.

Lesson learned...

Back in '97, my wife wanted a new car, but still wanted something sporty. In her daily travels, she saw a Nissan 240 SX (think Japanese Camaro). We went to the local dealer, and they had one we took around the block, which she liked, but didn't care for the color combo. They did a dealer swap, and got one in the color she wanted, but upon inspection, we found a small ding in the quarter panel.

The dealer said the "Ding Doctor" would take care of it. I knew the guy they were talking about, and he was a magician, but I told them that due to where this ding was, he'd more than likely drill an "access hole" to get his tools in there, and that wasn't acceptable to me. I told them to remove the back seat and side panel, so he could get it from the inside. Of course, they said, "OK", then of course, they didn't do it, so he drilled a hole in the door jamb area.

Bottom line, I went ballistic, and they had to ship in yet ANOTHER car, to keep me happy. However, after this long winded post, what I'm getting at, is that they did the car swap with us, and put the first car, the one we had for a month, licensed and titled in my wife's name, back on the lot as a "demo", with 900 miles on it.

Call the manager to get this squared away. Presume if the title was cleared of any prior encumberance and it then only shows you in the chain, then otherwise you have a new car that is to your satisfaction?

You just want the benefit of the bargain and hopefully have the vehicle in new condition as paid for. Not some war over a title issue.

Title issues are not that uncommon. We often hear complaints that the service departments are inept. Typically the clerical staff earn less.

When handling insurance claims I came across people with titles to somebody else's car. It wasn't often, but typically it was somebody who bought a car the same day, from the same dealer also had the wrong title. This was in NY. Even though it would take a while, even NY DMV would straighten it out.

At the time, this is going back a ways, Virginia DMV was the easiest to work with. I once called them for a title on an old wreck so we could dispose of it. In less than a week I received a title ... for a brand new Harley! We even got that fixed.

If the only issue you have is with the paperwork, and you like the vehicle, let them deal with DMV.

You just need to make sure your insurance policy reflects reality, just in case, God forbid, you need it.
