Key Fob AWOL
 
We picked up our 2011 Overland from the dealer on December 9, four weeks ago. The vehicle was new, sent from a dealer in another province. Before our dealer released the vehicle to us they let us know that one of the key fobs didn't arrive with the vehicle. It was noted on "the sheet" that they would either get that fob back or would provide us with a new one, and programmed for our vehicle.

Four weeks later we're still waiting for our second fob. The dealer kept stalling, saying the other dealership wasn't responding to them, going so far as to bring up provincial rivalries. We finally had enough and tracked down the dealership who had shipped the vehicle and asked about the missing key. They said both sets went with the vehicle. I let our dealer know this and was given the familiar "I'll have to check with my manager". I told him I want either our original key or a new key by this Wednesday. I chose that date since I have to bring in the vehicle on an unrelated warranty issue and the dealership is on the other side of the city.

So a couple of questions. First, what is my "or else" response if I show up Wednesday and I get excuses and no fob? What can I do to force the dealership to resolve this? I'm guessing this is going to be a 3-way squabble over who lost the second fob, and I'm almost positive it will end up that we will need to get a new fob. Since this will be at our dealer's expense, they're obviously stalling. Is this an issue that I can escalate to Chrysler to resolve? It's really a pain having only the one fob for two drivers, and even with the holidays almost 5 weeks seems pretty patient.

My other question/concern is if we do get a new fob, this means that our original fob is out there somewhere. If the carrier has the missing fob I assume their chances of finding our vehicle and stealing it or breaking into it are slim to nil. I suppose it's possible that someone at the dealership has the fob in which case it wouldn't be hard to get our address. Can I get the vehicle/our two fobs reprogrammed so that our vehicle won't accept the fob that went missing? Is that even technically possible?

Keys go missing all the time at dealerships. Calling Chrysler is a good way to go or if Canada has a BBB (Better Business Bureau) like in the US, you can get some traction that way.

Ultimately you want to remind them, calmly, that the dealer has not met their obligations for the sale of your vehicle. Tell them that they can either take the vehicle back or get your second key to you. (Now the least sentence is more of an empty threat, but one that the manager shouldn't take lightly and at least move faster on getting your key for you.)

They will argue that the deal is done, yadda yadda yadda... They will say you can't roll back the deal over a key... You simply state that you are not returning a vehicle because of a missing key, you are returning it for breach of contract and the dealership has failed to meet all requirements of your car deal. (This part you will want to seek proper legal counselling on if they don't comply, but saying the above will most likely get you the result you're looking for.)

You also want to remind the manager that it's not your fault/responsibility that the key went missing. Tell the manager to work it out with the other dealership after the fact, but you want your second key and you want it now.

In relation to this question, I believe that if any key fob is not present when the programming of a new fob is done, the missing fob no longer works. I'm sure someone can step in that is more knowledgeable than I on this topic.

I believe you are correct, they can delete the missing fob from the car's programing, making it no longer work with that vehicle.
